Cream Athens

Legal

This website is operated by Cream Athens. Patron’s House, its private membership programme, runs in collaboration with D Contemporary, which is the seller of record for sales. These terms apply across the site.

Privacy Policy

Who we are

This website is operated by Cream Athens (Athens, Greece), which is the data controller for the personal data described here. Patron’s House, our private membership programme, runs in collaboration with D Contemporary (London); where D Contemporary handles payments and sales, it acts as controller for that part of the process. Contact: info@creamathens.com, or, for payment and sales questions, irene@dcontemporary.com.

The data we collect

Account data (your name, email, and the password you set, stored hashed by our authentication provider); artist profile data (biography, portrait, and the details and images of works submitted); consent records (that you accepted the Artist Agreement, with date, time and version); enquiry data (anything you send through our forms or by email); purchase data (billing and delivery details, processed by our payment provider); and basic, privacy-friendly technical analytics.

How we use it, and our legal bases

To create and run your account (contract); to list, promote and sell consigned works (contract and legitimate interest); to respond to enquiries and applications (legitimate interest); to keep a record of agreement acceptance (legal obligation and legitimate interest); to process sales, payments and tax (contract and legal obligation); and to keep the site secure (legitimate interest). We do not sell your personal data, and we do not use it for advertising.

Who we share it with

We use a small number of trusted providers: Supabase (database, authentication and file storage); Vercel (hosting and privacy-friendly analytics); Resend (transactional emails); Stripe (payment processing); and D Contemporary as our gallery partner and, for sales, the seller of record who handles payment collection and VAT. Each provider processes data only on our instructions or as needed to provide their service. We do not share your data with anyone else except where required by law.

International transfers

Cream Athens is in Greece (EU) and D Contemporary is in the United Kingdom. Where a provider processes data outside the EEA, the transfer is protected by an adequacy decision or by Standard Contractual Clauses (and the UK addendum where relevant).

How long we keep it

We keep account and profile data for as long as your account is active, and consent and sale records for as long as needed to meet our legal and tax obligations. After that we delete or anonymise it.

Your rights

You have the right to access your data, correct it, have it deleted, restrict or object to processing, and to data portability. Email info@creamathens.com to exercise any of these, or, for payment and sales data held by D Contemporary, irene@dcontemporary.com. You may also complain to your local data-protection authority (in Greece, the Hellenic Data Protection Authority; in the UK, the ICO).

Cookies and analytics

We use privacy-friendly Vercel analytics, which set no cookies. With your consent we also use Google Analytics, which sets cookies to help us understand how visitors use the site. You choose on your first visit, and you can change your mind by clearing this site’s data in your browser. Sign-in uses your browser’s local storage to keep you logged in. We do not use advertising cookies.

Security and changes

Access to personal data is restricted, passwords are stored hashed, and private files are served through secure, access-controlled links. We may update this policy from time to time; the current version is always the one published here.

Terms of Use

About these terms

These Terms of Use govern your use of the Cream Athens website, which is operated by Cream Athens. Within the site, Patron’s House is a separate private membership programme that runs in collaboration with D Contemporary. The account, membership and consignment provisions in these terms relate to Patron’s House. By using the site or creating an account, you agree to these terms.

Accounts

Patron’s House is by invitation, and accounts are opened only for the artists and patrons we invite. You must be at least 18 and provide accurate information, and you are responsible for keeping your login details secure and for any activity under your account. Artists can manage their profile and submit works for review before they appear; they cannot delete a work but may request removal of an unsold one. Patrons are given access to view works and take part in the programme. Consignment of works is governed separately by the Patron’s House Artist Agreement, which artists accept when they submit works.

Acceptable use

You will not upload content you do not have the rights to, upload anything unlawful or infringing, attempt to gain unauthorised access, disrupt the service, or scrape, copy or resell its content.

Content and intellectual property

The site, its design and its content belong to Cream Athens and its partners and may not be reused without permission. Artists keep all rights in their own works, and by submitting a work grant the licence to display and promote it as described in the Patron’s House Artist Agreement. You are responsible for the content you provide and confirm you have the right to provide it.

Availability and liability

We aim to keep the site available but do not guarantee it will be uninterrupted or error-free, and may change or withdraw features. The site is provided “as is”. To the fullest extent permitted by law we are not liable for indirect or consequential loss. Nothing here limits any liability that cannot be limited by law, including your statutory rights as a consumer.

Termination and governing law

We may suspend or close an account that breaches these terms, and you may close your account at any time by contacting us. These terms are governed by the law of England and Wales, in keeping with the Patron’s House Artist Agreement. If you use the site as a consumer in the EU, you keep the protection of the mandatory laws of your country of residence.

Terms of Sale

Who you are buying from

Works offered through Patron’s House are sold by Grafton Street Contemporary Art Limited, trading as D Contemporary, of 1 Birdcage Walk, London SW1H 9HP, United Kingdom (“the Gallery”), presented in collaboration with Cream Athens. The Gallery is the seller of record and collects payment and handles VAT.

Placing an order

When you place an order, you make an offer to buy the work at the listed price, and a contract is formed when the Gallery confirms the order. Because each work is an original or a limited edition, it may become unavailable if it sells or is reserved elsewhere.

Prices, VAT and payment

Prices are shown exclusive of VAT, with VAT added where it applies. VAT treatment depends on the delivery destination, and the total including any VAT is shown before you confirm. Full payment is due before the work is released. The accepted payment methods, and any applicable surcharge, are shown at checkout, and payment is taken securely; we do not store your full card details.

Title and risk

Title to the work passes to you only on receipt of full cleared payment. The Gallery reserves the right to cancel the sale if payment is not received by the agreed date. Risk in the work passes to you on delivery.

Delivery and shipping

Delivery is by courier or by collection, as arranged after the sale. Shipping costs and delivery times are confirmed with you at checkout, and may be complimentary depending on the work and destination.

Authenticity

The Gallery provides a certificate of authenticity or equivalent documentation where applicable.

Returns and cancellations

All sales are final unless required by law or expressly agreed in writing, and there are no exchanges or refunds after collection or shipment. Where you buy as a consumer, your statutory rights, including any right to cancel a distance sale or to a remedy for a faulty or misdescribed work, are unaffected.

Copyright, reproduction and resale

Sale of a work does not transfer copyright. All reproduction rights remain with the artist unless separately agreed in writing, and you may not reproduce the work for commercial purposes without prior written consent. Resale of a work may be subject to the UK Artist’s Resale Right (ARR) or similar regulations where applicable.

Institutional loans

You agree to consider in good faith any future request from the artist or the Gallery to loan a work to a museum or major public institution of recognised standing, on mutually agreed terms as to duration, insurance, condition and transport. This is an expression of shared intent to support a work’s institutional life, not an obligation to lend in all circumstances.

Governing law

These terms are governed by the law of England and Wales, and disputes are subject to the exclusive jurisdiction of the courts of England and Wales. Consumers in the EU keep the protection of the mandatory laws of their country of residence.

Membership Terms

About membership

Patron’s House is a private membership programme run by Cream Athens in collaboration with D Contemporary. Membership is offered in two forms, for patrons (collectors and private clients) and for artists.

Membership and fees

Membership is by subscription. For patrons, it is €400 per year or €40 per month. For artists, it is €20 per month. Fees are exclusive of VAT, which is added where it applies, and the current price is always shown at the point you subscribe.

What membership includes

For patrons, private early access to new works, a curated selection of the artists we champion, and the space to build relationships within the programme. For artists, a place among the artists we champion, promotion and representation of consigned works, and the wider network of the programme. Consignment of works is governed separately by the Patron’s House Artist Agreement.

Billing and cancellation

Fees are billed in advance through Stripe. You may cancel at any time, and cancellation takes effect at the end of the current billing period, with access kept until then. Fees already paid for the current period are non-refundable, except where the law requires otherwise.

Ending membership and changes

We may end or suspend a membership that breaches these terms or the Terms of Use. Membership is personal to you and cannot be transferred. Where a change affects price or key benefits, we will give members reasonable notice by email.
